Cruelty... What's the first thought that arrives in your mind?? Against Women? Men? Children??? No m talking about against animals... which least of us are bothered!!! Cruelty against animals is the infliction of unnecessary pain or suffering on an animal it can include a range of actions such as beating, kicking, overworking, torturing, or otherwise causing physical harm to an animal. There are many laws which favour humans when it comes to justice but what about these innocent creatures whose languages we fail to understand???? Well any one who wishes to file a complaint against the person torturing these innocent creatures without reasonable justifications can file a complaint under Prevention of Cruelty to Animals Act, 1960. It encourages the reporting of such incidents to ensure the welfare and protection of animals. I am very concerned about a recent change in the law that affects the protection of animals from sexual assault. Before, there was a law called Section 377 of the Indian Penal Code (IPC) that made it illegal to harm animals in this way. However, this law has been removed under a new law called the Bhartiya Nyay Sanhita. This means that now, it is not against the law to sexually assault animals. This is really disturbing because statistics show that about one out of every eight cases of cruelty towards animals involves sexual assault or rape. Without the legal protection, there could be more acts of violence against animals and no one will be punished for these sexual crimes. I am questioning the reasons why this law was drafted and removed. It is important that we understand why this decision was made so that we can find ways to protect animals better. I believe it is essential to have strong laws that clearly condemn any form of sexual violence towards animals. We need to work together to ensure that animals are protected and treated with compassion and kindness. Let’s join hands and advocate for the reinstatement of legal safeguards that prevent animal cruelty, including sexual assault. Together, we can create a society that values the rights and well-being of all living creatures. #ProtectAnimals #StopCruelty #StandWithAnimals

The only way to avenge the brutal killing of Jai and countless other animals that have been brutally tortured or killed, and to prevent such dastardly crimes from being committed, is for the Parliament to make such heinous crimes a non-bailable offence in order to set an immediate deterrent. Not just that, the fine and jail term for animal cruelty under the Prevention of Cruelty to Animals (PCA) Act, 1960 needs a major overhaul. Thankfully, Section 429 of the Indian Penal Code (IPC), 1860 provides for stronger punishment as compared to the PCA Act, 1960. Under Section 429 of the IPC, the punishment for killing, maiming or rendering useless an animal is a jail term of up to 5 years or fine or both. Essentially, if an accused is convicted under Section 429 of the IPC, the maximum punishment that can be awarded by a Court is a jail term of 5 years. In fact, the court can even impose jail term and fine, both. It is a matter of judicial discretion depending on the severity of the offence. Did you know that the bail amount is never Rs 50? Most people confuse the fine under PCA Act, 1960 with the bail amount. Both are totally different. I will do a separate post on bail and punishment. However, something we must all remember is grant of bail doesn’t mean that the case is over. In fact, it has just begun with the registration of FIR. Police is required to file chargesheet post investigation basis which the court conducts a trial. Based on the evidence produced before the court, it decides on the guilt or innocence of the accused. If found guilty, the accused is convicted and punishment is awarded accordingly. This entire process could take a couple of years. Most of us expect instant justice which is not possible or permissible due to the nature of criminal justice system. We have to be patient and try to be a part of the process as much as we can so we know what is happening in our case and we can seek intervention where necessary. It is extremely important that we see through cases registered based on our complaints. That is truly when justice will be served. PETA India and several others have been long campaigning to strengthen and amend the PCA Act, 1960.
